to return to classes this week in a different school, and as terrell brown reports, an attorney for one of the children is ready to go to court. >> reporter: two weeks after a gunman opened fire inside sandy hook elementary a new haven lawyer is asking permission to sue the state of connecticut for $100 million. >> i'm saying for a fact that the state didn't do enough to provide for their safety. >> reporter: attorney irving pinsky represents the child, a 6-year-old who survived. she's traumatized of what she saw and heard in the school. >> the whole thing came down on the intercom, the screaming, the cursing, the bang bang bang and her friends are dead. >> reporter: pinsky filed the claim last week claiming that the state failed to protect the child and as a result she suffered trauma and injury. in all 20 children died and six staffers. staffers credited with trying to save lives. on pinsky's facebook page hundreds have expressed outrage. sickening. simply sickening. another wrote should be disbarred and jailed for abuse of the system and trauma caused to the parents whose childre

scott brown of massachusetts and richard lugar of indiana were defeated kent conrad and ben nelson both retiring and because the bill to avert the fiscal cliff did not address spending the new congress will be fighting the exact same battle as the last one. maryland congresswoman chris van hollen is the top democrat on the house budget committee. >> the inability to get a comprehensive agreement means we'll be dealing with the budget issues on an on again/off again basis for months to come. >> reporter: that means there are a couple more cliffs coming. this new congress is going to have to vote sometime in the next couple of months to raise the debt ceiling, and the truth, anthony and norah, is that this fiscal cliff was relatively simple to solve, if congress had so much trouble with that how are they going to tackle more difficult issues that they say they want to work on like immigration and tax reform. >> good question. nancy cordes thanks. >>> president obama signed a fiscal cliff legislation into law wednesday, after reyou nighting with his family in hawaii. chip reid is traveling

though let's go to terrell brown for a check of today's headlines. >> good morning, and happy new year. we begin with breaking news on the fiscal cliff. the senate approved the last-minute deal overnight, barely missing the deadline. the house could vote on it today. nancy cordes is on capitol hill with more this morning. nancy, good morning to you. >> reporter: good morning to you, terrell. happy new year. well there is one major hurdle left for this fiscal cliff deal that, is a vote later today in the house of representatives, perhaps as early as 1:00 in the afternoon. the senate voted well after the ball dropped in the early hours of the morning, passed overwhelmingly with lots of support from both sides. the final tally was 89-8. >> shouldn't have taken us this long to come to an agreement and this shouldn't be the model for how we do things around here but i appreciate the vice president's willingness to get this done for the country. >> reporter: vice president biden negotiated the deal with senate republicans over the weekend, but he also came to the hill last night to sell
